Tughans’ Construction Unit brings together lawyers with considerable experience in procurement, commercial property and construction litigation.

Our Experience
Procurement
We provide legal advice and support to the full range of entities involved in procurement of a project to ensure their commercial considerations are addressed in the process, be that contractors bidding to the public sector, sub-contractors, local authorities or construction professionals. We are experienced in providing thorough and relevant advice throughout the lifecycle of a construction project, from project planning and procurement, contract negotiation and award to contract management and dispute resolution.
Contentious
Our Construction Unit has represented a combination of public sector bodies and both international and local private sector building companies in High Court and County Court litigation, arbitration, and adjudication under the Construction Contracts (NI) Order 1997. Although it is our custom to adopt an aggressive approach to contentious work we are conscious that disputes can become protracted and costly. Consequently we offer experience in mediation as a form of alternative dispute resolution where appropriate.
Non-contentious
On the non-contentious side, members of the team have experience in advising employers, developers and contractors on all forms of contract, standard form and bespoke, and on professional team appointments and forms of collateral warranty agreement. Our experience extends to all types of major project work including PFI/PPP, project agreements, finance, building contracts and facilities management contracts.
We have also advised on the acquisition and disposal of a range of construction companies and businesses regarding the particular construction-related issues that arise in such transactions.
All-Ireland and international links
Supported by colleagues in our associate firm in Dublin, William Fry Solicitors, we are able to advise on construction matters with an all-Ireland dimension. We also have close links with other firms principally in the City of London and in the United States of America. Consequently, the firm regularly handles the Northern Ireland aspects of multi-jurisdictional transactions.
